How to defend yourself from a burglary accusation

Those accused of the crime of burglary may have been allegedly caught inside a building, in the possession of stolen goods or while breaking and entering. This is why those accused of burglary will likely need a very strong defense because there could potentially be significant evidence stacked against them.

However, this does not mean that those accused of burglary cannot successfully defend themselves. To do so, they will need to take swift actions and fully understand how the law applies to their situations. The following is an overview of the elements of the crime of burglary and how to defend yourself against accusations.

The elements of the crime of burglary

One defining element of burglary is the unauthorized breaking and entering of a building or occupied structure. This breaking and entering must also be combined with the intent to commit a crime. It is important to note that the theft of goods does not need to occur for a person to be convicted of burglary.

Defend yourself against burglary accusations

To defend yourself against a burglary accusation, you must be able to show that at least one of the elements of the crime was not present. For example, you may be able to show that you had no intention of committing a crime. Alternatively, you may be able to argue that you did not break in and enter a property and that you were authorized to enter the property in question.

If you have been accused of burglary and you are worried about the legal consequences, it is important that you take swift action to defend yourself.
